IN NO EVENT SHALL DEWEY'S PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

The limitations and disclaimers in this Section 7 do not purport to limit liability or alter your rights as a consumer that cannot be excluded under applicable United States federal or state law, including rights under the Federal Trade Commission Act (15 U.S.C. § 45 et seq.) governing unfair or deceptive acts or practices.

To the extent applicable, these Terms are also subject to state consumer protection statutes, including, for California residents, the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) with respect to your personal data.

10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of our Services by contacting Dewey's Pizza directly at [email protected]. We will make good-faith efforts to resolve the issue informally within thirty (30) days of receiving your complaint.

10.2 Binding Arbitration

You and Dewey's Pizza waive the right to a trial by jury and the right to participate in a class action lawsuit or class-wide arbitration to the fullest extent permitted by applicable law. The arbitration shall take place in the United States, and the arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

The allocation of arbitration costs and fees shall be governed by the applicable rules of the selected arbitration organization. If you are a consumer bringing a claim for personal, family, or household purposes, the costs of arbitration shall be allocated in accordance with applicable consumer protection laws.

10.4 Small Claims Court Exception

Notwithstanding the foregoing arbitration agreement, either party may bring an individual claim in small claims court in the appropriate jurisdiction, provided the claim qualifies for and remains within the jurisdiction of small claims court.

10.5 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
